The Delegation portal allows local authorities to securely delegate tasks and share information with external professionals through secure collaboration.

Schools have an identified EHCP team representative who is the lead for the cluster.
Individual children and young people will be allocated a caseworker when in the statutory process i.e. assessment or review.
Kirklees Delegated portals will allow settings to directly write into the annotated plan.
Kirklees remains committed to working in partnerships with schools. We are all bound by the Children’s and Families Act, and on occasions the EHCP Teams duty to work with families, within the legislation.

Kirklees remains committed to working in partnerships with schools. We are all bound by the Children’s and Families Act, and on occasions the EHCP Teams duty to work with families, within the legislation, may feel at the exclusion of some partners. We would never do this intentionally; however, the information below may help the context of when this may feel like we are not, particularly during at times which are not in term time.

As such requesting advice and consulting with schools must be undertaken in a timely way, giving the Local Authority time to make an informed decision by week 20 following the request for assessment.
The SEND Code of Practice section 9.80: The local authority must consult the governing body, principal or proprietor of the school or college concerned and consider their comments very carefully before deciding whether to name it in the child or young person’s EHC plan, sending the school or college a copy of the draft plan.
9.83 The nursery, school or college and, where relevant, the other local authority, should respond within 15 days. Where a nursery, school or college identified at 9.78 above is named on an EHC plan they must admit the child or young person.
When the local authority consults with a setting, it is not consulting ‘for a place’ we are asking the setting to consider whether they could be a suitable and compatible placement for the child and the setting will need to provide evidence that one or more of the legal test applies. These tests of ‘unsuitability’ and/ or ‘incompatibility’ are the only reasons that a setting cannot be named in Section I of an EHCP.
The local authority will give the school 15 days in which to respond. If the school fails to respond, the LA does not have to wait to make a decision about naming a school/college on the EHC plan. It is important that you, as leaders, understand the legislation and your role in the consultation process. This will help inform you to plan for out of term delivery.
